Introduction
Please read these terms of use carefully. By accessing our site or using our services, you acknowledge that you understand, agree, and are bound by these terms.
1. Submitting an Order
Submitting a purchase order to the website constitutes an offer to enter a contract for the provision of skip bin services with Spartan Bins. On receipt of confirmation of that order, you will be bound by a contract to purchase the services requested in the purchase order, subject to your rights to cancel or vary the order set out in these terms and conditions. You must be 18 years of age to purchase services using the website, and Spartan Bins reserves the right to decline orders on that basis.
2. Skip Bin Ownership
All skip bins hired by Spartan Bins to the client will remain the property of Spartan Bins during the period of the hire contract. The client will have no right to claim ownership and will have no interest in the skip bin once the hire contract has been completed.
3. Price
All prices include delivery and removal of skip bins. The price of the skip bin includes GST.
Once a quoted order is confirmed, the price of the goods and services stated cannot be amended unless Spartan Bins has expressly agreed in writing to that variation.
4. Access and Ground Conditions
Spartan Bins accepts no liability for any property damage during bin delivery and pickup. It will be the responsibility of the customer to ensure that the area chosen for placement is suitable for the skip bin.
The client will be responsible for ensuring that the skip bin truck has easy access to allow for drop off and pick up of the skip bin. The area is to be clear of any obstacles, be clear of overhead power lines and cables, as well as being able to bear the weight of the fully loaded skip bin and the truck transporting the skip bin.
Spartan Bins will not be liable for any damage to land or any property to driveways, gardens, grass, fences, car ports, garages, houses, personal property, cars or automobiles during the delivery and collection of the skip bin. The driver will make his own discretion whether it is safe for the placement of the skip bin, if customer does not comply with the driver, he has the right to cancel the order and a refund will be sent to the customer with a 30% fee deducted from the original total amount paid when ordering the skip bin.
5. Do Not Overfill or Overload
YOU AGREE TO ONLY FILL EACH HIRED SKIP BIN BENEATH THE TOP RIM OF THE SKIP BIN OR TO THE FILL LINE MARK OF YOUR ORDERED BIN SIZE. Any overfill waste will be placed back on to your property and left behind.
6. Alternate Supply
You accept that if we do not have the required Skip Bin available based on your requirements, then in consideration of the payment you make to Spartan Bins you agree for us to supply you with an alternate size Skip Bin suitable for the same (or similar) purpose, or we will arrange for next day delivery when we have the right size skip bin for you.
7. Restricted Waste and Hazardous Waste
You agree that in accordance with relevant Australian environmental laws including EPA Schedule 7 that you must not place any restricted waste inside the hired Skip Bin: NO ASBESTOS, NO TYRES, NO LIQUID OR HAZARDOUS WASTE, NO BATTERIES AND NO TREE STUMPS, FOOD SCRAPS, ACID OR FULL PAINT TINS, SYRINGUS AND GAS BOTTLES. If any of these items are in the bin the customer is responsible to empty these items out of the bin. If customer cannot be reachable Spartan Bins will notify the EPA that the skip bin came from your address and will be liable for disposal costs and incur sever fines.
8. Payment
Payment is to be made prior to delivery of the skip bin. Credit Card details will be retained until the Hire Contract of the skip bin has been completed.
Additional costs may be incurred if prohibited items are placed in the skip bin, or wrong items.

9. Burning Items in Skip Bin or Missing Skip Bin
Under no circumstances are items in the skip bin to be incinerated. Any damage caused by fire will be passed on to the client.
Under no circumstances customer cannot call or let any other skip bin company to pick up Spartan Bins, Skip Bins unless its Spartan Bins, any skip bins that are missing on the time of pick up the client will be responsible and liable for costs involved.
10. Order Cancellation and Variation
The client will be entitled to cancel or vary an order provided that Spartan Bins receives notice of cancellation or variation no later than two working days prior to the delivery date. Any other variation to your order will be at Spartan Bins discretion. In the event an order is cancelled by Spartan Bins which is due to circumstances beyond our control the client will receive a full refund of any monies paid for the cancelled order. You accept that upon delivery of the hired Skip Bin and client decides to cancel a $150 dollars Fee will be deducted from amount, No full refund will be accepted.
11. Waste
Spartan Bins reserve the right to charge the client directly for any fees incurred for incorrect waste or excess weight that has been placed in the bin. Please insure you place the right waste that you originally ordered due to different charges at different Recycle Transfer Stations. (Please Refer to our Page Types of Waste and the different categories waste is recycled).
The driver has the right to ask the client to check his waste upon delivering the skip bin and at his discretion he has the right to let the client know how much extra charges it will be if wrong contents are place in the bin. If the client does not co-operate the driver has the right to cancel the bin and you will be refunded and a 30% fee will be deducted from the total price paid when ordering the bin.
If upon pick up and the driver sees that the wrong waste has been placed in the bin and client does not co-operate or cannot be reachable to pay the extra charges, the driver will place all the rubbish back on to the driveway and a refund will be given back to the client with a fee deducted of $150 dollars for company costs.
12. Sole Responsibility
You agree that you are solely responsible for the hired Skip Bin upon delivery of the Skip Bin at the delivery site.
13. Same Day Delivery
Spartan Bins is committed to getting the job done, we cannot give you a time on the day of Delivery due to the Logistics of the business, which sometimes could be out of our control. The office will call you 20-30 minutes before the driver will arrive. Spartan Bins recommends that you have your skip bin delivered the day or night before you want to use the bin, so your skip bin is there ready for you when you want to use it. Spartan Bins does not close until we have delivered all our bins no matter what time it will be, unless the client thinks it will be too late and deliver the bin the next working day, so please do not worry your bin will be delivered on the Same Day unless there is something beyond our control the office will call you if we need to tell you that your bin will be delivered the next working day. Skip Bins stay for 5-10 days Inside your Boundary or driveway we cannot place bins on the road or Nature Strip due to needing a Council Permit, we do not do Permits.
If by any chance we cannot place the bin inside your boundary Spartan Bins also offers other alternatives we usually can recommend the driver can wait for 30-40 mins and you can load your bin up. You must pay the driver first if you are paying cash, the driver will give you a receipt to sign and then he will place the bin down, you load the bin up and then driver can take the bin and drive off. You must have your rubbish ready to go so you can load your rubbish quicker.
Termination
Spartan Bins reserves the right to terminate access to our site and block future use of our services if we deem these Terms of Use have been violated
